These Terms of Service ("Terms") govern your access to and use of the TruckingJobsInUSA website located at https://truckingjobsinusa.com ("Site") and all related services provided by TruckingJobsInUSA ("Company," "we," "us," or "our"). We reserve the right to deny access to the Site or any portion thereof to any person or entity at our sole discretion, at any time and for any reason, including but not limited to violation of these Terms.

2. Description of Service

TruckingJobsInUSA operates an online job board and career resource platform focused on the trucking and commercial driving industry. Our services include job listings for CDL drivers and related positions, company profiles and reviews, state-by-state job guides, CDL training resources, salary data and comparisons, career advice articles, and industry tools and calculators.

We serve as an intermediary connecting job seekers with employers in the trucking industry. We do not directly employ drivers, guarantee employment, or serve as a staffing agency. The actual terms of employment, including compensation, benefits, and working conditions, are determined solely between the job seeker and the hiring company.

We may modify, suspend, or discontinue any aspect of our services at any time without prior notice. We may also impose limits on certain features or restrict access to parts of the Site without notice or liability. We continually work to improve our services and may add or remove features at our discretion.

3. User Accounts and Registration

Certain features of our Site may require you to create an account and provide registration information. You agree to provide accurate, current, and complete information during registration and to update that information to keep it accurate, current, and complete. You are responsible for safeguarding the password associated with your account and for any activities or actions under your account.

You agree not to create accounts using false identities, automated methods, or on behalf of others without authorization. You must not share your account credentials with any third party or allow anyone else to access your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate any account that we reasonably believe violates these Terms, contains false information, or has been compromised. We will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. User Content and Conduct

You may submit content to our platform including resumes, applications, reviews, and comments ("User Content"). You retain ownership of your User Content but grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and providing our services. This license terminates when you delete your User Content or account.

You are solely responsible for your User Content and represent that it is accurate, does not violate any law, and does not infringe on the rights of any third party. You agree not to submit content that is false, misleading, defamatory, obscene, threatening, discriminatory, or otherwise objectionable. Resumes and applications must contain truthful information about your qualifications, experience, and CDL credentials.

We reserve the right to remove or modify any User Content that we determine, in our sole discretion, violates these Terms or is otherwise harmful to our users, our services, or third parties. We are not obligated to monitor User Content but may do so at our discretion.

5. Job Listings Disclaimer

Job listings on our platform are provided by third-party employers and recruiters. While we make reasonable efforts to ensure the accuracy and legitimacy of listings, we do not guarantee the accuracy, completeness, or reliability of any job listing, salary information, company description, or other employment-related content provided by third parties. You should independently verify all information before making employment decisions.

We do not guarantee that you will receive a response to any application, obtain an interview, or secure employment through our platform. The hiring process is entirely between you and the employer. We are not a party to any employment agreement and are not responsible for the actions, representations, or conduct of any employer or job seeker using our platform.

Salary data, pay ranges, and compensation information presented on our Site are estimates based on publicly available data from sources including the Bureau of Labor Statistics, industry surveys, and user submissions. Actual compensation will vary based on experience, location, employer, endorsements, and other factors. Salary figures should be used for informational and comparison purposes only.

6. Intellectual Property

All content on this Site, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, is the property of TruckingJobsInUSA or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The TruckingJobsInUSA name, logo, and all related marks are trademarks of TruckingJobsInUSA.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes related to your job search or hiring activities. This license does not include the right to copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our prior written consent.

Our career guides, salary data compilations, state job guides, and original articles are original works of authorship and are protected by copyright. You may share links to our content but may not reproduce substantial portions of our articles, data, or tools on other websites or publications without express written permission.

7. Prohibited Uses

You agree not to use our Site or services for any unlawful purpose or in any way that violates these Terms. Prohibited activities include but are not limited to: scraping, crawling, or using automated tools to extract data from our Site without written permission; posting fraudulent job listings or false information; attempting to gain unauthorized access to our systems, user accounts, or data; transmitting viruses, malware, or other harmful code.

You may not use our platform to engage in spam, unsolicited marketing, phishing, or any form of deceptive communication. You may not impersonate another person or entity, misrepresent your affiliation with a company, or create fake accounts for deceptive purposes. Employers may not use our platform to discriminate against applicants based on race, color, religion, sex, national origin, age, disability, or any other protected characteristic.

You may not reverse-engineer, decompile, or disassemble any portion of our Site or services. You may not use our Site to collect personal information about other users without their consent. Violation of these prohibited uses may result in immediate termination of your access and may be reported to appropriate legal authorities.

8. Limitation of Liability

To the fullest extent permitted by applicable law, TruckingJobsInUSA, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Site or services.

We shall not be liable for any damages resulting from employment decisions made based on information found on our platform, actions or omissions of third-party employers or job seekers, unauthorized access to or alteration of your data, or any third-party content, products, or services accessed through our Site. Our total cumulative liability for all claims arising from or related to these Terms shall not exceed the greater of one hundred dollars ($100) or the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law. The limitations in this section apply regardless of the theory of liability, whether based on warranty, contract, statute, tort, or otherwise.

9. Indemnification

You agree to defend, indemnify, and hold harmless TruckingJobsInUSA, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

This indemnification obligation includes any claims arising from User Content you submit, your interaction with employers or job seekers through our platform, your violation of any applicable law or regulation, and your infringement of any third-party intellectual property or privacy rights. You agree to cooperate fully in the defense of any such claim.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. This indemnification obligation will survive termination of these Terms and your use of the Site.

10. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Dover, Delaware. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against TruckingJobsInUSA. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Kent County, Delaware. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction.

11. Termination

We may terminate or suspend your access to the Site and services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at info@truckingjobsinusa.com. Upon termination of your account, we will delete your personal information in accordance with our Privacy Policy. Any User Content that has been shared with employers through submitted applications may remain with those employers and is subject to their own data retention policies.

Termination of your account does not relieve you of any obligations incurred prior to termination, including any indemnification obligations. We shall not be liable to you or any third party for any termination of your access to the Site or services.

12. Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes that significantly affect your rights or obligations, we will provide reasonable notice through a prominent posting on our website or by email to registered users.

Your continued use of the Site after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Site and, if applicable, close your account. It is your responsibility to review these Terms periodically for changes.

No modification to these Terms by any party other than TruckingJobsInUSA shall be valid or binding unless made in writing and signed by an authorized representative of TruckingJobsInUSA. Previous versions of these Terms are available upon request.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of any other provision.

The remaining provisions of these Terms shall continue in full force and effect. The parties agree to negotiate in good faith a replacement provision that most closely reflects the original intent of the invalid provision while complying with applicable law.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and TruckingJobsInUSA concerning your use of the Site and services. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and TruckingJobsInUSA regarding the Site.

No oral or written statement by any representative of TruckingJobsInUSA, other than what is contained in these Terms, shall create any obligation or modify these Terms in any way. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

These Terms do not create any third-party beneficiary rights. Our rights under these Terms may be assigned by us without restriction. Your rights and obligations under these Terms may not be assigned without our prior written consent.
